(hereinafter referred to as “PINK ADVENTURES LIMITED”) operates a platform for tracking habits (hereinafter referred to as “Platform”) on the Internet portal mindzona.com. In this context, PINK ADVENTURES LIMITED allows you to enter the goals and habits you wish to form, provides reminders to carry out these habits at the time you specify, and enables you to change their status to "completed", "skipped" or "postponed" on any day. PINK ADVENTURES LIMITED will then transform your input data into graphs and charts.

The use of the platform is subject to the following terms and conditions, which are valid at the time of registration or order. PINK ADVENTURES LIMITED does not recognise any other general terms and conditions that you may have, unless PINK ADVENTURES LIMITED has agreed to their validity in writing.

Please note that no separate contract text is provided for the Agreement regarding the use of the platform. The agreement between you and PINK ADVENTURES LIMITED is based on these terms and conditions, as well as on the particular information provided during registration and subscription, which will be stored by PINK ADVENTURES LIMITED and made available in your user account at any time.

By registering for and/or purchasing a paid subscription, you accept these Terms and Conditions.

2. Purchases

Should you wish to purchase a product or service made available through the Service, we may request certain information relevant to your purchase. This may include, but is not limited to, your credit card number, expiration date, phone number and address.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

The service may use third-party services to facilitate payment and the completion of purchases. By submitting your information, you grant us the right to provide it to these third parties in accordance with our Privacy Policy.

PINK ADVENTURES LIMITED subscriptions are paid subscriptions that allow you to access content and features through our web-based application. There are 3 different subscription options (Plans):

  • Advanced statistics dashboard
  • Early access to new features
  • Deep AI analysis of progress trends
  • Monthly 1-on-1 coaching session with your personal coach

We currently offer the following subscription / service package:

  • Starter service package will charge you 49.99 EUR on a monthly basis with a _-day Trial Period available for 2.35 EUR
  • Advanced service package will charge you 69.99 EUR on a monthly basis with a _-day Trial Period available for 2.35 EUR
  • Premium service package will charge you 89.99 EUR on a monthly basis with a _-day Trial Period available for 2.35 EUR

You will have access to the respective services as long as your subscription is valid.

5.2 Purchase agreement

By entering the requested information in the online order form and clicking on the "COMPLETE PAYMENT" button, you will submit a legally binding offer for a fee-based subscription. By proceeding with this action, you are submitting a legally binding offer for a paid subscription agreement. Prior to submitting your order, you have the option to change and view the data at any time.

The agreement will be accepted by PINK ADVENTURES LIMITED upon the issuance of a notice of acceptance, which will be sent to you immediately by email (receipt and order confirmation). Your subscription will begin on the specified date.

6. Refund Policy

6.1 General information

Refund Window: According to our refund policy, customers have a period of two weeks from the date of purchase to request a refund. Verification Process: In the interest of security, we may request specific customer information, including email address, phone number, first and last name, current address, reason for the refund, and any other relevant details to validate the transaction. Prompt Processing: We endeavour to process customer requests as promptly as possible, with response times varying based on the nature of the refund request. PINK ADVENTURES LIMITED will inform customers about the reimbursement process within the timeframe set out in our policy. Authorisation criteria: Refunds are authorised or declined only after thorough verification of the provided data. Service Cancellation: Should customers wish to discontinue the use of our services, they must inform us by unsubscribing in order to avoid additional charges.

6.2 Requesting a Refund

Subject Line: To ensure efficient processing, please use 'Refund Request' in the email subject line. Payment Method: Refunds will be issued using the original payment method, so as to ensure that the refund amount does not exceed the initial transaction. Refund Eligibility: Please note that only the second charge is refundable, as the first payment is made independently after acknowledging the terms listed on our website. Partial Refunds: PINK ADVENTURES LIMITED reserves the right to consider partial refunds based on the services that have been provided.

6.3 Refund Processing

Information Request: Should further information be required, customers will be contacted within fourteen days of the refund request. This information must be provided within fourteen days. Decision Notification: A definitive decision regarding the refund will be communicated via email within five working days of receiving the requested final information, or within five working days of receiving the refund request if no further information is required. Prompt Processing: Once approved, refunds will be processed within ten business days. Refund Ineligibility: Please note that refunds cannot be approved if the specified timeframe has passed or if the customer declines to provide the necessary information.

6.4 Chargebacks

Issue Resolution: Customers are encouraged to contact us to resolve transaction-related issues before initiating a chargeback. Investigation Process: In the event of a chargeback, PINK ADVENTURES LIMITED will conduct an investigation and may request additional information from the issuing bank.

Refund Ineligibility: Once a chargeback is initiated, the customer is no longer eligible for a refund.

6.5 Additional Terms

Please note that requesting a refund does not guarantee approval. Additional fees: Please be advised that customers are responsible for any additional fees incurred during the refund processing. Policy Updates: PINK ADVENTURES LIMITED reserves the right to amend the Refund Policy in response to legislative changes or as deemed necessary. We kindly ask customers to periodically review this page for updates. Acceptance of Terms: If a customer is unable to accept the updated terms of the Refund Policy, they must discontinue using our services. The new policy will apply to any subsequent purchases made after the update. Please note that PINK ADVENTURES LIMITED accepts no liability for any losses or damages, whether direct or indirect, that may be incurred by users of our services, including those relating to refund processing or processing time.

7 Cancellation Policy

The subscriber confirms their awareness of and consent to the exclusive nature of all content on the website belonging to the PINK ADVENTURES LIMITED, and acknowledges the copyright, trademark, and other intellectual property rights associated with this content. By confirming that you are of legal age and agree to pay all membership fees, as well as acknowledging the representations, warranties and acknowledgments outlined in this Agreement, you are granting the Company the right to grant you a single user license to access its computer servers and use the Website solely for your personal, non-commercial entertainment and enjoyment.

By using the Website, subscribing to a membership, accessing password-protected areas of the Website, downloading "member's only" content, or accepting these Terms and Conditions, you acknowledge and accept all of the terms, warranties, conditions, obligations, and other provisions set forth in this Terms and Conditions. You also authorise and accept full financial responsibility for all charges specified in this Agreement.

Should you require a refund, please get in touch with our Support Team within 14 days of the charge. To terminate your membership, you are required to cancel your subscription a minimum of two days prior to the conclusion of the current term. For those on a trial membership, this cancellation must be made within the trial period. Access to certain features is restricted to members who have recently upgraded or started a new subscription.

Please be aware that the Company will automatically renew your membership to the Website if you do not send a request to cancel your membership to the Company at least two (2) days prior to the membership expiration term (including any free or promotional membership terms) or within the trial membership period.

The Company reserves the right to terminate any membership at any time and for any reason.

The Company reserves the right to suspend or terminate your membership in the following circumstances:

  • if you breach these Terms & Conditions,
  • if you misuse the Site, Platform, or Services,
  • if required by law or regulatory authority,
  • if payment is not received.

All cancellations must be received by the Company at least TWO (2) DAYS prior to your membership expiring in order for them to take effect.

Please be advised that upon the expiration of your membership, your password will be permanently deleted from the system. However, you will retain access to all membership benefits until the end of your membership period, unless either you or the Company choose to cancel. In the event of termination of membership prior to the end of the current membership month, a refund will not be issued.

The Service and its initial content, features and functionalities are and will remain the exclusive property of PINK ADVENTURES LIMITED and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of both the United Kingdom and foreign countries. Please note that our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PINK ADVENTURES LIMITED.

10. Account Termination

We reserve the right to terminate or suspend your account and bar access to the Service with immediate effect, at our sole discretion, for any reason and without prior notice or liability, including but not limited to a breach of the Terms.

Should you wish to terminate your account, you can do so by navigating to the account settings and selecting the relevant option.

All clauses of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

You hereby agree to defend, indemnify and hold harmless PINK ADVENTURES LIMITED and its licensee and licensors, and their respective employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) that may arise from or in connection with: a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

In no event shall PINK ADVENTURES LIMITED, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

It is hereby stated that the right to modify or replace these Terms is reserved at the sole discretion of the relevant parties, and that such modifications may be made at any time. In the event of a revision being deemed material, a minimum of 30 days' notice will be provided prior to the implementation of any new terms. It is important to note that, by continuing to access or use the Service after any revisions have been implemented, the user will be bound by the revised terms. Should the new terms not be accepted, authorisation to use the Service will be withdrawn.
